2. Acceptance of Terms
By creating an account on sitewatch.work, submitting a verification request, or making a payment, you agree to be bound by these Terms of Service. If you do not agree with any part of these Terms, do not use the Service.
We may update these Terms from time to time (see Section 14). Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
3. The Service
What SiteWatch Does
SiteWatch connects diaspora homeowners with local Verifiers in Zimbabwe who perform GPS-verified site visits to properties. The Verifier travels to your specified property, takes photographs, records GPS coordinates to confirm they were at the correct location, and produces a Report documenting what they observed.
What SiteWatch Does NOT Do
SiteWatch is a documentation service only. We want to be very clear about what we are not:
- We are NOT engineers, architects, or building inspectors. Our Reports do not constitute engineering certification, structural assessment, or professional inspection of any kind.
- We do NOT certify construction quality. A Report showing construction progress does not mean that work was done correctly, safely, or to code.
- We do NOT evaluate builders or contractors. We do not rate, endorse, or certify the competence of any builder working on your property.
- We do NOT provide legal opinions about property boundaries, ownership disputes, or zoning compliance.
- We do NOT guarantee project outcomes. A verification visit documents a moment in time โ it does not predict future progress or completion.
A SiteWatch Report is the equivalent of someone you trust going to look at your property and sending you photos with notes about what they saw. Nothing more.
4. Customer Obligations
As a Customer, you agree to:
-
Provide accurate information. You must supply a correct and complete property address or location description so the Verifier can find the site. If the address is wrong or incomplete and the Verifier cannot locate the property, you may forfeit your payment.
-
Have a legitimate reason for the request. You must have a reasonable interest in the property being verified (e.g., you own it, you are funding construction on it, or you have permission from the owner).
-
Pay the stated fee. Payment of $65 USD per verification visit is required at the time of request. Payment is processed through Stripe.
-
Not misrepresent Reports. You may not present a SiteWatch Report as an engineering assessment, professional inspection, or certification of any kind to any third party.
-
Maintain account security. You are responsible for keeping your login credentials secure. Notify us immediately at [email protected] if you suspect unauthorized access.
5. Verifier Obligations
Verifiers operating through SiteWatch agree to:
-
Report honestly. Document only what is actually observed at the property. Do not fabricate, exaggerate, or omit material observations.
-
Use GPS verification. All visits must include GPS-tagged photographs confirming the Verifier was physically present at the specified location.
-
Make no certification claims. Verifiers must never represent themselves as engineers, inspectors, or certified professionals. They must not make statements about structural integrity, code compliance, or construction quality.
-
Complete visits promptly. Visits should be completed within the timeframe communicated to the Customer at the time of request.
-
Maintain confidentiality. Property information, Customer details, and Report contents must not be shared with unauthorized third parties.
-
Act professionally. Conduct site visits respectfully and without interfering with any ongoing work at the property.
6. Pricing & Payment
Fees
- Each verification visit costs $65 USD.
- Payment is collected at the time you submit a verification request.
- All payments are processed securely through Stripe.
Refund Policy
-
Verifier cannot access the site: If the Verifier is unable to reach or access the property (e.g., gated community with no entry, road impassable, property cannot be located despite correct address), you will receive a full refund of $65.
-
Report delivered: Once a Report has been delivered to you, no refund is available. The service has been performed.
-
Disputes: If you believe a delivered Report is materially inaccurate, incomplete, or that the Verifier did not actually visit the property, you may file a dispute within 7 days of receiving the Report by contacting [email protected]. 7. Reports
Delivery
Reports are delivered electronically through your SiteWatch account. You will be notified by email when your Report is ready.
What a Report Contains
A typical Report includes: - GPS-tagged photographs of the property - Written notes describing what the Verifier observed - Date and time of the visit - GPS coordinates confirming the visit location
What a Report Does NOT Contain
Reports do not include: - Engineering or structural assessments - Opinions on construction quality or code compliance - Professional valuations or appraisals - Guarantees about the property's condition beyond what is visible
Accuracy Disclaimer
Reports reflect what was observed by the Verifier at the time of their visit. Photos and notes represent a point-in-time snapshot, not a professional assessment. Conditions may change before or after the visit. SiteWatch does not guarantee that every detail of a property's condition will be captured in a single visit.
Ownership
Once delivered, the Report is yours to keep and use for personal purposes. However: - SiteWatch retains the right to use anonymized or aggregated data from Reports for internal quality assurance and service improvement. - You may share your Report with third parties (family, builders, etc.) but must not misrepresent it as a professional inspection or certification. - The Report format, templates, and branding remain the intellectual property of Whitney Troy Holdings LLC.
8. Limitation of Liability
This is important โ please read carefully.
SiteWatch provides a documentation service. We are not responsible for:
- Construction quality. If your builder does poor work, SiteWatch is not liable. Our Reports document what we see, not what should have been done.
- Builder performance. We do not manage, supervise, or oversee builders. A Report is not a performance review.
- Structural assessment. If a building has hidden defects that are not visible during a surface-level site visit, SiteWatch is not responsible for failing to identify them.
- Property damage or loss. SiteWatch is not liable for any damage to property, theft, or loss that may occur at any time, whether or not related to a visit.
- Decisions based on Reports. If you make financial, legal, or construction decisions based on a Report, you do so at your own risk. Reports are informational documentation, not professional advice.
To the maximum extent permitted by law, SiteWatch's total liability to any Customer for any claim arising from the Service is limited to the amount paid for the specific verification visit in question (i.e., $65).
SiteWatch is not liable for indirect, incidental, special, consequential, or punitive damages of any kind.
9. Independent Contractors
Verifiers are independent contractors, not employees of Whitney Troy Holdings LLC.
- Verifiers set their own schedules and determine how to complete their visits.
- Verifiers are paid per visit ($45 USD via EcoCash USD).
- Whitney Troy Holdings LLC does not provide benefits, insurance, or employment protections to Verifiers.
- Verifiers are responsible for their own taxes, equipment, and transportation.
Nothing in these Terms creates an employer-employee relationship, partnership, or joint venture between SiteWatch and any Verifier.
10. Intellectual Property
- The SiteWatch name, logo, website design, and Report templates are the property of Whitney Troy Holdings LLC.
- You may not copy, reproduce, or create derivative works from our branding, website, or proprietary systems without written permission.
- Content you submit (property addresses, instructions) remains yours, but you grant us a license to use it as necessary to provide the Service.
- Verifier-created content (photos, notes) within Reports is licensed to Whitney Troy Holdings LLC and sublicensed to the Customer upon delivery.
11. Account Termination
By You
You may close your account at any time by contacting [email protected]. If you have a pending verification request, it will be completed and the Report delivered (or refunded, per Section 6) before account closure.
